Logolance automatically collects certain information as you browse the Website. We collect a users IP address, general location, browser type, and browser software version. Additionally, we store information obtained from your browser using cookies. A cookie allows Logolance to store basic session details that allow users to login, logout, and allows the Website to provide content along the way. These cookies are terminated after a short period of time of inactivity. In the future, we may also store persistent, long-term, cookies that store your login email to make it easier for you to login when you return to the Logolance Website. In this case, we will not store your password in a cookie.
When you become a Member on Logolance, you provide us with certain personal information such as your full name, phone number, email address, and password. This information specifically identifies you and your Account on Logolance, and allows you to login and access the Website Member areas. In order to submit a Project to Logolance, we also require your address.
As a Designer, you may choose to provide additional personal information such as your username, URL, phone number, bio, time zone, and an image in order to display this information on your public portfolio/profile webpage (“Portfolio Page”). Aside from your phone number, all of this information will be shown publicly on your Portfolio Page, and be accessible publicly to everyone and to any search engine. Your phone number is not shown publicly. Any images that you upload to your portfolio will also be shown publicly to anyone and to any search engine. Logolance does not have any obligation for information you provide that is shown on your Portfolio Page or information that you otherwise voluntarily make available to other Members on the Website.
When posting a Project, you are required to provide certain information related to the Project so that Designers may review your Project, submit proposals, and provide Designer Services. All Project information is always kept private from public Website users. Only certain information is made available to Logolance Designers so that they may submit proposals for your Project, and this information is only available when they are authenticated and logged in to the Website.
The information made available to Logolance Designers includes:
• Your design contract and NDA
• Your estimated project start date
• Your project title and summary
• Any uploaded project materials. If you don’t want these to be available to Designers you have not hired, simply wait to upload any documents until after your project has started.
• Your budget
As a Designer, you have the ability to submit a proposal to work on a Client Project. Your proposal includes a proposal message that you create, links to your Portfolio Page, thumbnails of some of the images within your portfolio, and your contact information including your name, phone number, and email address. This information is provided so that the client may contact you and make an informed decision related to your proposal. Most of the information provided in your Proposal is already public information, as it is displayed within your Portfolio Page.
On various parts of the Website, Logolance allows you to provide the email addresses of your friends or associates in order to send them a communication through the Website. These email addresses are saved in our system for this one-time communication and are not provided to any third parties except for those responsible for delivery of our email or maintaining our email systems. We keep records internally about the email addresses to which we send email communications, which are primarily used to provide opt-out functionality so that a user may unsubscribe and choose to no longer receive emails from Logolance. Email addresses that we collect from your referrals will not be included in any weekly/monthly or otherwise recurring email schedule or email list. We may, however, choose to send certain one-time communications to these email addresses in the event we would like to share information about Logolance that we feel is important.
As a Designer, you have the ability to use the Logolance Website to communicate with the Client, including but not limited to sending messages and uploading images. As a Client, you have the ability to communicate with the Designers working on your Project, including but not limited to sending messages, uploading documents, and sending project updates. These communications are kept private between a Client and Designer and are not used for any purpose other than to facilitate communication between the Client and Designer.
On certain occasions, we may conduct surveys or contests through the Website. These are optional and if you choose to partake, any information you provide will be kept anonymous, unless you provide us written permission otherwise. We may disclose certain information you provide through a contest to third parties, if it is necessary for the contest or prize fulfillment.
Through the Payment Service, Logolance collects payment information in order to receive payment from a Client and pay a Designer. We may collect information related to your credit card, bank account, PayPal account, or other financial institution information. While collecting, processing, or transferring a payment we may provide your personal and financial information to third parties as necessary to complete the billing operation.
We provide your information to third parties in certain situations:
a. To comply with a legal request, such as a search warrant, court order, or subpoena. In such circumstances, we limit disclosure until we have a good faith belief that such disclosure is reasonably necessary, or that it meets applicable legal standards.
b. When we believe it is necessary to prevent fraud or other suspected illegal activities.
c. When we believe it is required to protect our interests, rights, reputation or property, or those of our users, Members, affiliates, or partners.
d. We may provide your information in aggregate, without personally identifying you, to third parties for market research, analyzing user behavior, or for other business or marketing analysis.
e. Content or personal information that you provide may be accessible to search engines such as Google, Yahoo, or Bing. The “web crawlers” for these sites will be unable to access your profile page if you limit access based using your privacy settings.
f. Information that you provide to public sections of the Website will be accessible by anyone, including all search engines.
g. We may provide your personal information to third party service providers to help provide the services of the Logolance Website. We may use third parties to provide our underlying data network, host our web servers, provide our storage, deliver our email, process our payments, or provide our marketing material or advertisements. Through the performance of these business activities, our service providers may have access to your personal information.
h. Logolance reserves the right to transfer your user information to a successor if interest in ownership of all or substantially all of Logolance were to change.
i. We may send you email communications that are necessary to provide the Logolance service, or to send other information or advertisements. You may opt-out and request to discontinue the receipt of emails from Logolance by clicking on a link on the bottom of any email sent from Logolance.
j. Throughout various stages of a Project, we provide certain personal information, Project information, and contact information for Designer and Client to each other. This is provided so that Designers may provide and Clients may receive services through the Website.
k. If another Member requests your contact information, we will disclose your contact information to the Member (including full name, phone number, address, email address, and company name) provided that the request is related to a Project posted on Logolance. In such an event, we will also provide you with the requesting Member’s contact information. You agree to only use personal information that you collect from other Logolance Members to provide services through the Website or resolve a dispute.
Logolance works with certain third party software providers in order to provide the Website, and sections of the Website may include code or scripts from third parties. These third party software providers may have access to certain personal information collected through the Website. Google is used to provide analytics data to Logolance, and both Google and Logolance will have access to your anonymous traffic data.
We will take appropriate industry-standard precautions to protect your information and prevent the access, misuse or loss of your data. Your information is stored behind physical and software firewalls, and access is only permitted to authenticated sessions initiated on Logolance servers. The network on which Logolance hardware and software resides provides protection for Denial of Service Attacks, Man in the Middle Attacks, IP Spoofing, and Packet Sniffing. The data centers used to host Logolance servers are protected by physical access control, video surveillance, and intrusion detection systems. When sensitive information is entered through the website, this data is encrypted for transit using SSL technology, to help protect your financial data and login information.
However, no amount of physical or virtual security is impenetrable. We try hard to keep your data private and secure, but we cannot guarantee privacy or security. Logolance has no control over the actions of other users with whom you may share your information. Furthermore, the security and stability of the Logolance Website is reliant on hardware and software which can fail and other factors that could potentially compromise your information, such as unauthorized user access or the actions of hackers. All sharing of personal and Project information through the Logolance Website is done at your own risk.
